The use of this website and its software tools, information, and content (the “services”) shall be subject to acceptance of and compliance with the terms and conditions set forth in these terms of use and policies (the “terms of use”, “terms”) and elsewhere on this site. Additionally, every order and transaction that is concluded through our site is governed by our terms. The terms of use apply to all visitors, customers, members, and wholesalers (“you, “your”, “yours”, “member”, “yourself”, “customer”). We reserve the right to update, change or replace any part of these Terms of Use by posting updates and/or changes to our website. If you do not agree to these terms of use, you may not access this site or utilize our services.
- Qualifications
This site and its services are not intended for children under the age of 13. You must be at least 18 years of age to utilize our Services and place an order. Children over the age of 13 and under the age of 18 must be supervised by a legal guardian who agrees with the Terms of Use. The site and its services are intended for only U.S. residents. - Revisions to the Terms of Use
We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. - Intellectual Properties
The templates, graphics, illustrations, photographs, fonts, logos and information (the “content”) are copyright properties of bannerNprint or properties of suppliers/third parties from whom bannerNprint has licensed such properties. The content may not be copied, distributed, reproduced, sold, and/or published.
You may not upload files including graphics, images, logos, photographs, etc. that infringes upon or violates the intellectual property rights of bannerNprint or others. If you are using element(s) such as logos, graphics, photographs, etc., from a third party, you must receive permission prior to placing an order. It is exclusively your responsibility to seek legal advice from a lawyer if you have questions regarding intellectual property rights of your design. By placing an order on our site, you agree that your design does not infringe upon any intellectual property rights and does not violate section 4 of the Terms of Use.
- Violations
When utilizing the site and its services, you must abide by the following conditions, but not limited to:
(i) Your design submission must not have content that is abusive, vulgar, defamatory, offensive, harassing, malicious, pornographic, obscene, hateful, libelous, profane, harmful, or threatening. Your print must not be used to slander, defame, discriminate based on race, ethnicity, gender, sexual orientation, or disability.
(ii) Your design submission must not contain any viruses or contaminating codes that is designed to interrupt or damage the site and its services.
(iii) Your design must not violate the rights of any intellectual property including but not limited to trademarks, patents, or copyrights.
(iv) Your design must not violate any state, federal or international laws or regulations.
(v) Your design must not have content that is false or misleading. Your print must not be used to spam
We have the sole discretion to terminate your use of the site and its services and cancel your order in the event that you violate any of these conditions. You agree that bannerNprint shall have no liability to you or to any third party regarding the termination and cancellation of your order.
- Limited License
This site grants you only a limited, nonexclusive license to use your print for your own personal use. You may not use your print for republication, distribution, or sale. Creating derivative works based on the content of the site is prohibited. - Indemnification
By utilizing this site, you agree to indemnify, defend, and hold harmless bannerNprint and our partners, licensors, affiliates, suppliers, contractors, subsidiaries, and employees, from and against any and all claims, demands, actions, and expenses (including attorney’s fees and costs), arising out of or in connection with any of the following:
(i) your breach of the Terms of Use
(ii) your violation of any intellectual property right
(iii)your violation of any state, federal or international laws or regulations.
(iv) any claim that your content violates the legal rights of any other party
You agree to give bannerNprint the right to control the defense, settlement and resolution of any claim at your expense. You may not settle any claim without bannerNprint’s permission.
- Designer Tool
This site contains a design software (“Designer Tool”) that provides elements such as text, fonts, shapes, images, backgrounds, templates, and graphics. Other bannerNprint customers may use the combination of elements to create designs that look similar or possibly identical to various designs. We reserve the right to modify, add or delete elements without prior notice. - Prints
By submitting your order through the site, you grant bannerNprint the permission to print your design and make any revisions to your design for the purpose of fulfilling your order. You also grant bannerNprint the right to use your print (i.e. photo of your final product) for promotional purposes such as social media marketing, email marketing, and advertising. Upon request, bannerNprint will remove the content. - Color Discrepancies
Due to different monitors and their various display settings, bannerNprint cannot guarantee that the colors of your design will be a perfect match to the colors of the actual print. We will not provide any refunds regarding color discrepancies. It is the responsibility of the customer to upload files that are in CMYK mode. Learn more about CMYK mode here. - Errors & Inaccuracies
While we do our best to provide accurate information regarding our products, pricing, and content, there may be mistakes from time to time. We reserve the right to correct any errors or inaccuracies without prior notice. If you have already submitted your order and a pricing error has been discovered, please contact our customer service department. If necessary, we can cancel your order or provide a partial/full refund. - Third Party Links
This site may contain links to other third-party websites. We are not responsible for the content, accuracy or opinions expressed on these websites as well as the privacy and security operations. It is not our responsibility to monitor or check the content of these third-party websites. By accessing these websites, you agree that it will at your own risk. - Disclaimer
